Afrocart – Terms of Service

1. Acceptance of Terms
By accessing or using afrocart-zw.com or any Afrocart mobile application (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must stop using the Service immediately.
These Terms form a legally binding agreement between you and Afrocart. We may update these Terms at any time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
2. Description of Service
Afrocart is an online marketplace connecting buyers and sellers in Zimbabwe. The Service includes:
- Product listing tools for sellers
- A marketplace for buyers to browse and purchase goods
- Secure payment processing via third‑party providers (e.g., Stripe)
- Messaging and communication tools
- Order management and delivery tracking
- Support tools for dispute handling
Important: Afrocart is an intermediary platform. We are not a party to transactions between buyers and sellers. Sellers are responsible for their products, listings, and fulfilment. Buyers are responsible for their purchase decisions.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. By using the Service, you confirm that you meet these requirements.
4. User Accounts
4.1 Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and up‑to‑date information
- Keep your login credentials secure
- Notify us immediately of any unauthorised access
- Accept responsibility for all activity under your account
4.2 Account Termination
We may suspend or terminate your account if you violate these Terms, engage in fraud, misuse the platform, or for any reason at our discretion.
5. Buyers
5.1 Product Listings
Product descriptions, images, prices, and availability are provided by sellers. Afrocart does not guarantee the accuracy, completeness, or legality of listings.
5.2 Purchasing
By placing an order, you agree that:
- All purchases depend on product availability
- Prices are set by sellers and may vary
- Delivery fees and timelines are determined by sellers or delivery partners
- You must provide accurate delivery information
- Orders become binding once payment is confirmed
5.3 Payments
Payments are processed securely through Stripe. By paying, you agree to Stripe’s terms. Afrocart does not store full card details.
5.4 Order Acceptance
- Sellers must accept or decline orders within 3 working days
- If a seller does not respond within this period, the order is automatically cancelled and refunded
5.5 Returns and Refunds
Return and refund policies are set by individual sellers (typically 7 days).
Buyers must contact sellers directly for returns. Afrocart may assist but is not obligated to resolve disputes.
6. Sellers
6.1 Seller Obligations
Sellers agree to:
- Provide accurate product descriptions, pricing, and images
- Maintain stock levels
- Accept or decline orders within 3 working days
- Fulfil orders promptly and as described
- Provide clear return/refund policies
- Comply with Zimbabwean and UK laws
- Deliver excellent customer service
6.2 Prohibited Items
Sellers may not list:
- Illegal, stolen, or counterfeit goods
- Items violating intellectual property rights
- Hazardous or dangerous materials
- Weapons, drugs, or controlled substances
- Adult content or services
- Any items prohibited under Zimbabwean or UK law
6.3 Fees and Payments (Updated Commission Structure)
Afrocart charges a commission on completed sales as follows:
- First 30 days after seller registration: 0% commission
- After 30 days: 5% commission per completed sale
Additional terms:
- Standard payment processing fees (Stripe) apply
- Sellers are paid 24 hours after successful delivery
- Minimum withdrawal amounts may apply
- Commission changes will not apply retroactively to completed sales
6.4 Ratings and Reviews
Buyers may leave public reviews. Sellers may not manipulate or interfere with reviews.
7. Intellectual Property
7.1 Afrocart’s IP
All platform content (logos, text, graphics, software) is owned by Afrocart or its licensors and protected by copyright and trademark laws.
7.2 User Content
By uploading content, you grant Afrocart a non‑exclusive, worldwide, royalty‑free licence to use, display, reproduce, and distribute your content on the Service.
You confirm that you own or have rights to all content you upload.
8. Prohibited Conduct
You agree not to:
- Use the Service for illegal purposes
- Violate any applicable laws
- Infringe intellectual property rights
- Post false or misleading content
- Manipulate prices or engage in unfair practices
- Harass or abuse users
- Attempt unauthorised access
- Interfere with platform operations
- Use bots or scrapers without permission
- Circumvent payment or security systems
9. Data Protection & Privacy
Afrocart complies with:
- UK GDPR (United Kingdom General Data Protection Regulation)
- Zimbabwe Cyber and Data Protection Act (2021)
We process personal data lawfully, fairly, and transparently.
Your data is used to operate the Service, process payments, prevent fraud, and improve platform functionality.
Your rights include:
- Access to your data
- Correction of inaccurate data
- Request deletion (where applicable)
- Restriction or objection to processing
- Data portability (UK GDPR)

10. Delivery & Logistics
Afrocart may work with independent delivery partners (“Delivery Pals”).
Delivery partners are not employees of Afrocart.
Afrocart is not liable for:
- Delivery delays
- Delivery partner actions
- Loss or damage during transit
Sellers are responsible for ensuring safe and timely delivery.
11. Disclaimers & Limitation of Liability
11.1 Platform Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind.
Afrocart does not guarantee:
- Product quality, safety, or legality
- Accuracy of listings
- Seller performance or fulfilment
- Successful dispute resolution
- Uninterrupted or error‑free service
11.2 Limitation of Liability
To the maximum extent permitted by law, Afrocart is not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business
- Issues arising from transactions between buyers and sellers
Our total liability shall not exceed:
The amount you paid to Afrocart in the past 12 months, or £100 — whichever is greater.
12. Indemnification
You agree to indemnify and hold Afrocart harmless from claims arising from:
- Your use of the Service
- Your violation of these Terms
- Your content or products
- Disputes with other users
13. Dispute Resolution
13.1 Buyer–Seller Disputes
Users must resolve disputes directly. Afrocart may assist but is not required to mediate.
13.2 Disputes with Afrocart

13.3 Governing Law
These Terms are governed by the laws of England and Wales.
Disputes shall be resolved exclusively in the courts of England and Wales.
14. Termination
We may suspend or terminate your access at any time. Upon termination:
- Your right to use the Service ends immediately
- You remain responsible for outstanding obligations
- Sections such as IP, liability, and indemnification continue to apply
15. Changes to Terms
We may modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date.
16. Severability
If any part of these Terms is found invalid, the remaining provisions remain in full force.
17. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and Afrocart.
